Injuction

Commercial Law Court – Our firm acted on behalf of Whelan Frozen Foods Limited in relation to their business relationship with Dunnes Stores and the purported termination by Dunnes Stores of the warehousing and logistic service provided by Whelans over a long number of years. The Plaintiff’s application for an interlocutory injunction restraining Dunnes Stores from the unilateral variation of certain Terms and Conditions of the contract between the parties came on for hearing before his Honour Mr. Justice MacMenamin who delivered judgment on 17th February 2006 when he granted the injunction as sought by the Plaintiffs. This is believed to be one of the very few injunctions granted by the Commercial Law Court.

The Plaintiff’s claim for damages and other reliefs came on for Hearing before Mr. Justice Feeney on 11th July. Following protracted negotiations between the parties the matter settled on terms confidential between them. The firm instructed Mr. Paul Gallagher SC and Mr. Shane Murphy SC who appeared with Mr. Paul Anthony McDermott BL. The Defendants were represented by Messrs. Matheson Ormsby & Prentice solicitors.
